Contract Terms and Conditions for the purchase or sale of a pony.

Terminology

Pony/Ponies = equine of any type
Buyer = the person purchasing the pony
Seller = Newoak stud/Oaklands Riding Stables
Vetting = pre-purchase veterinary examination

The pony has been advertised by the seller based on a true description and on the current condition of the pony. The buyer must be aware that this is a living animal and that how it is cared for by the buyer once purchased will have an effect on its wellbeing and character e.g. turnout, feed, exercise, yard environment ect.
The Seller has the rights to sell the pony.
The buyer is responsible for making sure the pony is suitable for their needs/use.
Buyer is recommended to view the pony in person to check satisfactory quality, including fitness for purpose.
Buyer is recommended to get the pony vetted before purchasing.
All vetting’s are at the cost of the buyer.

Deposit/payment

A non-refundable deposit of ….% / 10% of the agreed cost of the pony is required to secure the pony and to prevent it from being offered to another buyer for 2 weeks.
If the buyer hasn’t collected or arranged transport within the 2 weeks period then the seller has the right to cancel the contract, readvertise the pony and except another offer.
If the condition of the pony changes within the 2 weeks which effects the quality, including fitness for purpose then they will return the deposit.
The remaining cost of the pony must be made in full before the pony can leave the sellers property.

Transport

The transport of the pony must be arranged, and any cost covered by the buyer.
The buyer takes ownership at the point of the pony being paid for in full and before point of loading onto transport.

Passport

A matching passport for the pony will be given to the buyer when the full payment of the pony. Has been received by the seller.
It is the buyers responsibility and legal responsibility to update the ownership details on the passport within 30 days of purchase the pony. By the buyer updating the passport they are excepting the ownership of the pony.

Trial Period

If the pony goes on a trail period, a set period of time must be agreed by both parties before sale.
The pony must be paid for in full to the seller before the trial.
The pony must be insured by the buyer to cover all public liability, veterinary costs and the value of the pony. If the pony is causes damage, gets injured or dies then any costs fall to the responsibility to the buyer.

Return policy for distance selling contract.

If the buyer cancels the contract within 30 days of purchasing the pony, then the buyer is responsible to arrange and pay in full for the transport of the pony to be returned to the seller.
The seller will refund the purchase price to the buyer once the pony has been returned and conditions checked to be the same as when the pony was sold.
If they pony is not returned to the seller in the same condition as sold, then the seller has the right to retain enough to cover the losses and refund the difference.

Warranty

No warranty is given concerning any pony.
